SPOUSAL SPONSORSHIP

 

 

The Canadian government is a strong advocate of keeping families together, one of the objectives of the Canadian government is to see families together in Canada. The applications under family sponsorship such as sponsoring your spouse are given highest priority. Spousal Sponsorship must be sponsored by a Canadian citizen or permanent resident either inside or outside Canada by the spouse, common-law or conjugal partner. Once the application is approved authorities will issue the applicant’s spouse Visa and confirmation of permanent residence. 
Applicants once they land in Canada before the expiry of their visa will become a permanent resident. For the applicants inside Canada, once the application is approved their status will change from temporary to permanent and also have the option of applying for open work permit while the application is in process. Applicant outside Canada has the option of applying a visitor visa to meet the loved one.

 

 

SPONSOR ELIGIBILITY & MINIMUM INCOME REQUIREMENTS

You can become a sponsor if you are:

1. a Canadian citizen, a person registered in Canada as an Indian under the Canadian Indian Act or a permanent resident,
2. at least 18 years old.
3. living in Canada:

a) if you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when your sponsored relative becomes a permanent resident.
b) You can’t sponsor someone if you’re a permanent resident living outside of Canada.

You must also be able to show that you can provide basic needs for:
1. yourself,
2. your spouse or partner,
3. your spouse or partner’s dependent child(ren) (if applicable).
4. your dependent child(ren) (if you’re sponsoring only your dependent child). 

Note: In most cases, there is no low-income-cut-off (LICO)
for a spouse, partner or dependent child sponsorships. However, if either a spouse or partner you’re sponsoring has a dependent child who has dependent children of their own, or a dependent child you are sponsoring has a dependent child of their own, you must meet a minimum LICO score, which is determined by the Canadian government each year. If you must meet LICO requirements, you must include a Financial Evaluation (IMM 1283) form with your application.

 

 

YOU MAY NOT BE ABLE TO SPONSOR IF YOU…

1. signed an undertaking for a previous spouse or partner and it hasn’t been three years since they became a permanent resident,
2. receive social assistance for a reason other than disability,
3. previously sponsored someone and did not pay back any social assistance that they received while the undertaking was in place.
4. are in default on an immigration loan or a performance bond.
5. did not pay court-ordered alimony or child support.
6. have declared bankruptcy which has not been discharged.
7. were convicted of

a) an offence of a sexual nature,
b) a violent crime,
c) an offence against a relative that caused bodily harm or
d) threatened or attempted to commit any of the above 
offences—depending on the nature of the offence, how long ago it happened and if you received a pardon. 

8. were previously sponsored as a spouse, common-law or conjugal partner and became a permanent resident of Canada less than five years ago,
9. are under a removal order,
10. are in a penitentiary, jail, reformatory or prison,
11. have already applied to sponsor your current spouse or partner and haven’t received a decision.

PARENT/GRANDPARENT

 

If you are a Canadian citizen or permanent resident you might be eligible to sponsor your parents and grandparents to come to Canada and live with you permanently. Leaving your family behind is hard and one of the main objectives of the Canadian government is family reunification. 
This is one of the high demand immigration streams which allows you to live with your loved ones permanently in Canada. 
Immigration, Refugees and Citizenship Canada changed the system for Parent and Grandparent Sponsorship in 2017 from first-come, first-served to a lottery. 
Families are asked to fill in an initial online form expressing interest in the program, with the allotted quota (10,000 for 2017 and 2018) drawn from all those expressing an interest. The 10,000 drawn must submit an application within 90 days. 
Sponsoring your parents/grandparents under family class sponsorship is a three-step process:

Step 1: Check if you are eligible to apply. 

Step 2: Fill a short form online expressing your interest to sponsor your parents/grandparents. 

Step 3: Canadian Immigration selects random applicants in a draw and invite them to apply, completed applications must be sent within 90 days from receiving an invitation to apply. 


 

ELIGIBILITY REQUIREMENTS

Only those who meet the eligibility requirements should submit the form in order to ensure the online application system’s efficiency. 
In order to be eligible to sponsor one’s parents and grandparents to become a permanent resident under the Family Class, applicants must be: 

1. At least 18 years old.
2. A Canadian citizen or permanent resident of Canada.
If you sponsor your parents and grandparents to come to Canada as a permanent resident, you must:

a) Meet certain income requirements.
b) Support that person and their dependants financially.
c) Meet the Minimum income requirement for this program by submitting notices of assessment issued by the Canadian Revenue Agency (CRA) in support of their sponsorship.
d) Sponsors must also demonstrate they have met the minimum necessary income level for three consecutive years. If married or in a common-law relationship, the income of both persons can be included; and
e) The sponsor and the sponsored relative must sign a sponsorship agreement that commits the sponsor to provide financial support for the sponsored person for up to 20 years. 

If you are not invited in 2018, you may try again in 2019.
If you want your parent or grandparent to visit you in Canada, you can apply for a super visa.
